TERMS AND CONDITIONS FOR USING THE WEBSITE

The website available at the domain http://www.just-grips.cz (hereinafter referred to as the “E-shop”) is created and operated by Grips & More s.r.o., Business ID: 216 62 371, with its registered office at Na Roudné 443/18, Severní Předměstí, 301 00 Plzeň, registered in the Commercial Register maintained by the Regional Court in Plzeň under file number C 45330 (hereinafter referred to as the “Operator”).

General Terms and Conditions for Using the E-shop

These terms and conditions governing the use of the E-shop (hereinafter referred to as the “Terms of Use”) apply to all visitors and users of the E-shop located at http://www.just-grips.cz, operated by the Operator.

By using the E-shop or clicking on any link, users confirm their agreement with these Terms of Use. If any user disagrees with these terms, they are not authorized to use the E-shop or the Operator’s services.

Users are obliged to adhere to the contractual terms outlined in these Terms of Use. In the event of any violation of these provisions, the Operator is entitled to enforce measures contained in these Terms of Use and/or permitted by applicable laws.

Changes to the Terms of Use

The Operator reserves the right to modify or supplement these Terms of Use at any time without prior notice. To stay informed about any changes, users are advised to review these Terms of Use regularly. The use of the E-shop is subject to the current version of the Terms of Use at the time of access.

Access and Availability of the E-shop

Access

Access to the E-shop is free and available to everyone. Access to certain parts of the E-shop may require the creation of a personal account. Users bear the costs related to internet connection and equipment necessary for using the E-shop.

Users must not interfere with or disrupt the functionality of the E-shop. Access to the E-shop by any means other than the interface provided by the Operator is prohibited and considered unauthorized.

Availability

The Operator reserves the right to limit the availability of the E-shop, especially due to regular maintenance or technical issues beyond the Operator’s control. However, the Operator guarantees to make every effort to ensure the E-shop is available, except in cases of force majeure or other uncontrollable circumstances.

User Behavior

Users are responsible for their actions related to the use of the E-shop provided by the Operator.

Users must not use the E-shop for activities that are or could be in violation of the laws of the Czech Republic, good manners, generally recognized principles of internet use, or these Terms of Use and the legitimate interests of the Operator.

Users allowing others to post content on the E-shop or share the Operator’s services are responsible for ensuring that such services are used in compliance with these Terms of Use and applicable laws. Users must compensate the Operator for any damages incurred due to improper use of the E-shop or services, either by themselves or by others they allowed to use the services.

The Operator may terminate or restrict access to the E-shop without compensation if:

  • The user violates these Terms of Use;
  • The Operator reasonably suspects that the user is using the E-shop in violation of applicable laws, ethics, or good manners, or for unlawful purposes;
  • The user exploits, blocks, modifies, or disrupts any functionality of the E-shop;
  • The user has not used their account for more than six months;
  • Other breaches as specified.

If it is possible to download certain elements of the E-shop, the User may use such elements exclusively for personal use, provided that all copyright and proprietary notices remain intact. Any other use, including but not limited to reproduction, distribution, modification, public display, or transmission of the downloaded materials, is prohibited without the prior written consent of the Operator.

The User agrees not to attempt to interfere with the proper functioning of the E-shop, including but not limited to bypassing, disabling, or otherwise interfering with any security features of the E-shop or features that enforce limitations on the use of content.

Disclaimer of the Operator’s Liability

  1. The Operator shall not be liable for the uninterrupted availability or functionality of the E-shop. The Operator does not guarantee that the E-shop will operate without interruptions or errors, nor does it guarantee its suitability for any particular purpose.

  2. The Operator shall not be liable for damages caused by the inability to use the E-shop, whether due to technical issues, temporary unavailability of services, or other causes beyond the Operator's control.

  3. The Operator assumes no responsibility for the content of third-party websites that may be linked from the E-shop. Such links are provided for the User's convenience only, and the Operator does not endorse or verify the accuracy of such third-party content.

  4. The Operator shall not be responsible for damages caused by the improper use of the E-shop or by actions contrary to these Terms and Conditions of Use.

User Obligations

  1. The User undertakes to use the E-shop in accordance with applicable laws and these Terms and Conditions of Use.

  2. The User shall refrain from any activity that could interfere with the functionality of the E-shop, disrupt its operation, or harm the Operator or other users.

  3. The User is prohibited from using the E-shop to distribute illegal content, spread malware, or engage in activities that violate the intellectual property rights of the Operator or third parties.

  4. In the event of a breach of these obligations, the Operator reserves the right to restrict or terminate the User’s access to the E-shop without prior notice and, if necessary, to seek compensation for damages caused.

Protection of Personal Data

  1. The Operator processes personal data in accordance with the applicable laws of the Czech Republic and the European Union, particularly Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR).

  2. Detailed information about the processing of personal data, including the rights of data subjects and the purpose of data processing, is provided in the Privacy Policy, which forms an integral part of these Terms and Conditions of Use.

  3. By using the E-shop, the User acknowledges that their personal data may be processed to the extent necessary for the proper functioning of the E-shop, order processing, and customer support.

  4. The User may withdraw consent for the processing of personal data at any time by contacting the Operator at info@just-grips.cz.

Intellectual Property Rights

  1. All content available on the E-shop, including but not limited to text, graphics, images, logos, product descriptions, and software, is the exclusive property of the Operator or its licensors and is protected by applicable intellectual property laws.

  2. The User is not authorized to reproduce, distribute, modify, or otherwise exploit the content of the E-shop without prior written consent from the Operator, except for personal and non-commercial use.

  3. Any unauthorized use of the E-shop’s content may result in legal action and the obligation to compensate the Operator for any damages caused.

  4. The trademarks, trade names, or logos displayed on the E-shop are registered or unregistered trademarks of the Operator or third parties. The User is not granted any license or right to use these trademarks without the explicit consent of their respective owners.

Final Provisions

  1. These Terms and Conditions are valid in the wording stated on the website of the Operator on the day the Purchase Contract is concluded.

  2. The Operator reserves the right to amend or supplement these Terms and Conditions. Changes or additions will not affect Purchase Contracts already concluded but will apply to contracts concluded after the amendment takes effect.

  3. Should any provision of these Terms and Conditions be or become invalid or unenforceable, it shall not affect the validity and enforceability of the remaining provisions. In such a case, the parties agree to replace the invalid or unenforceable provision with a valid and enforceable provision that comes as close as possible to the purpose of the original provision.

  4. Any disputes arising from these Terms and Conditions or the Purchase Contract shall be resolved primarily by mutual agreement. If no agreement is reached, disputes shall be resolved by the competent courts of the Czech Republic in accordance with Czech law.
